The responsible person shall initiate an investigation to ascertain the causes and reason for the incident occurring.
7.1.2 The responsible person, shall ensure that the site is made safe and that action has been taken to identify the most obvious cause(s) of the incident and protect against recurrence.
7.1.3 The responsible person, or person nominated by the responsible person, shall take steps to preserve the site immediately after the incident and, if this is not possible, to make records of all relevant details.
7.1.4 In the case of fatalities, the scene must not be disturbed until permission is obtained from the Relevant Authorities. The scene and all evidence shall be preserved to prevent deterioration as much as possible.
7.1.5 The investigation shall collect and preserve information prior to the site or operation being disturbed or restarted. This will normally include:
(a) Identification of witnesses and taking evidences;
(b) Documentation and procedures in operation at the time of the incident;
(c) Phase of operations, process condition, etc;
(d) Markings left by equipment involved;
(e) Position of persons and equipments;
(f) Documentation of emergency response procedures
immediately following the incident;
(g) Time of day;
(h) Prevalent weather conditions and
7.1.6 The investigation shall be conducted in cooperation with any contractors involved in the incident. However, a contractor can conduct a separate investigation according to its own procedures.
7.2 Investigation Timing
The investigation must take place as soon as practicable after the incident.

8. Reports
8.1 Incident reports
8.1.1 All incident shall be reported by the responsible person in a accordance with the following:
a) Within two business days of the occurrence of an incident, a licensee shall submit to the Authority a completed version of the form in Appendix A2 - Initial Incident Reporting Form to the office of Vice Governor for Consumers & Service Providers Affairs, telephone

8.1.2 In the light of the incident, the Authority may call for the furnishing of information which is more extensive or different from that required to be prepared to the Authority under Clause 8.1.1 and a b.
8.2 Actions and Recommendations
8.2.1 The licensee must ensure that a system is in place for tracking any actions highlighted from the investigation.
8.2.2 The licensee shall undertake a review during a period agreed between the Authority and the licensee of a fatality or any incident identified by the Authority, to ascertain if the main learning points and corrective actions taken to prevent recurrence of an incident have been implemented.
8.2.3 The licensee shall, within the period agreed between the Authority and the licensee following the review, submit to the Authority a close-out report of all the recommended actions related to the incident.
