Rules for Licensing and Supervision of Branches of Forgien Insurance and-or Reinsurance Companies in Saudi Arabia

V. 1 practicing insurance and/or reinsurance business in Saudi Arabia without: 4.4.1 Confirmation from the home supervisory authority that the Applicant is currently licensed to carry out the same proposed line of insurance business in its home jurisdiction, and has been writing the same line of business for the past three years. 4.4.2 Confirmation from the home supervisory authority that the Applicant is solvent and meets all regulatory requirements in its home jurisdiction 4.4.3 Undertaken from the Applicant that he meets the solvency requirements that would apply if the Applicant were based in Saudi Arabia. 4.4.4 Confirmation from the Applicant that the paid up capital of the Applicant is equal to, or more than, the amount required for a Saudi established insurance and/or reinsurance company. 4.4.5 Undertaken from the Applicant that the Branch will not engage in و/أو إعادة تأمين في المملكة العربية :السعودية دون توافر ما يلي تأكيد من السلطة الرقابية يف البلد الأم أن مقدم الطلب مُ رخَّ ص له حالي ا بمزاولة نفس َّأنشطة التأمين المقد ُم طلب الترخيص بها، وأنه تمت ممارستها على مدى ال ثلاث سنوات .الماضية تأكيد السلطة الرقابية في لبلد ا الأم أن مقدم الطلب يتمتع بالملاءة المالية وم ستوف جميع المتطلبات التنظيمية لديه ا. تعهد مقدم الطلب باستيفائه لمتطلبات الملاءة المالية ي الت تنطبق كما لو كان مقر مقدم الطلب في المملكة العربية السعودية. تأكيد مقدم الطلب أن رأس ماله المدفوع يساوي أو يزيد عن المبلغ المطلوب لأي شركة تأمين و/أو إعادة تأمين.محلية تعهد مقدم الطلب بأن الفرع لن يباشر أغراض ا تختلف عن V. 1 any activities other than insurance and/or reinsurance activities for which it is licensed by SAMA, unless those activities are necessary or complementary for such activities. 4.4.6 Confirmation from the Applicant that SAMA may exchange and share relevant supervisory information with the Applicant’s home supervisory authority at the time of licensing and after licensing. 4.4.7 Undertaken from the Applicant that the Branch will operate in accordance with the Law and its Implementing Regulation as well as SAMA’s Instructions and other related laws. أعمال التأمين و/أو إعادة التأمين التي حصل على ترخيص من المؤسسة لمزاولتها إلا إذا كانت لازمة أو مكملة .لتلك الأعمال تأكيد مقدم الطلب على أحقية المؤسسة في تبادل المعلومات الرقابية ذات الصلة بمقدم الطلب مع السلطة الرقابية في البلد الأم خلال مرحلة طلب الترخيص أو بعد إ صدار الترخيص. تعهد مقدم الطلب بأن الفرع سيزاول له ا عم أ بموجب النظام ولائحته التنفيذية وتعليمات المؤسسة والأنظمة ذات العلاقة.
