1. If the power of attorney is gratuitous, the agent shall, in the performance
thereof, exercise the same level of care he would exercise in the conduct of
his own affairs and shall not be required to exceed the care of a reasonable
person.
2. If the power of attorney is for a fee, the agent shall exercise reasonable care
in the performance thereof.
