1. A surety in a suretyship contract must be a fully competent person. 2. If a terminally ill person enters into a suretyship contract as a surety, such contract shall not be deemed effective vis-a-vis his heirs with regard to the part that exceeds one-third of the estate, unless the heirs ratify the contract. If the beneficiary of the suretyship contract is an heir, whether as a debtor or a creditor, such contract shall not be deemed effective vis-a-vis the other heirs, even if the amount does not exceed one-third of the estate, unless the heirs ratify the contract.
