1. If the person subject of custody is under the age of two and custody is not claimed by a

person entitled thereto, the mother, if available, shall be ordered to take custody of the
person subject of custody; otherwise, the father shall be ordered to do so.
2. If the person subject of custody is over the age of two and custody is not claimed by a
person entitled thereto, the father, if available, shall be ordered to take custody of the
person subject of custody; otherwise, the mother shall be ordered to do so.
