1.The court of appeals shall schedule a hearing to consider the appeal or petition for revision if it determines to consider the same by means of a hearing. If the appellant or the person filing the petition for revision fails to appear before the court after being notified of the date of the hearing, and 60 days have lapsed without making a request to proceed with the case or failing to appear in court after commencement of proceedings, the court shall, on its own motion, rule that his right to appeal or to file a petition for revision is deemed forfeited, without prejudice to the provision of Article 185(4) of this Law. 2.The court of appeals shall consider the appeal or petition for revision based on the documents provided in the case file and new defense or evidence presented by litigants in support of their grounds for appeal as stated in the brief. Upon hearing the testimony of litigants with respect to the appeal or petition for revision, the court shall, if it decides to consider the case by means of a hearing, affirm or reverse the judgment either wholly or partly and rule on the reversed part.
