A court shall not be bound by a penal judgment related to a case brought before
it, except for the facts for which a decision was rendered and a decision was
necessary. Nevertheless, the court shall not be bound by a judgment of
acquittal unless the judgment is based on refuting the commission of the
incident by the accused.
