The owner of the plant patent is obligated to do the following:
a) Maintain the protected variety or, when necessary, its hereditary
components for the whole duration of the term of protection.
b) Provide the Authority, upon its request, and within the specified period, with
information, documents, or necessary material to prove his maintenance of
the variety.
c) Propose a suitable denomination for the variety, within the specified period,
in case its denomination is cancelled by the Authority.
d) Provide the Authority when necessary, upon its request and within the
specified period, with reasonable samples of the protected variety or its
hereditary components for the following purposes:
1. Establishing or renewing the official sample of the variety.
2. Undertaking a comparative test of other varieties for protection purposes.
In case the owner of the plant patent does not observe any of these obligations,
the plant patent shall be forfeited after notifying him of the necessity of fulfilling
his obligation and giving him a reasonable grace period to fulfill the obligation
he has violated. In all cases, forfeiture of the plant patent shall be entered in the
register and published in the Gazette. The Regulations shall specify the grace
periods stated in this Article.
