The person who registers a trademark shall be deemed its exclusive owner and
the use of a registered trademark by any other person shall be conditioned upon
the consent of its owner. The owner of a registered trademark shall have the
right to file a lawsuit to prevent others from using it or from using any other
similar sign which may mislead the public as to the products or services for
which the trademark is registered as well as to similar products or services. The
rights arising from the registration of a trademark shall exclude the fair use of
the signs, statements, and descriptive illustrations which do not include the
distinctive feature of the registered trademark.
