1Implementing Regulations of The Cooperative Insurance Companies Control Law

1. The Company and the Insurance and Reinsurance Services Provider shall submit in writing to SAMA its intentions to cease its insurance activities in any one class or classes of insurance in the Kingdom accompanied the following particulars: عڴى الشركة وأصحاب المهن الحرة الذين يرغبون ࢭي إٰڈاء نشاطهم ࢭي المملكة بالكامل أو ࢭي فرع أو أك؆ر من فروع ال تأم؈ن، أن يقدموا طلباً كتابياً إڲى ا لمؤسسة يرفق به البيانات الآتية: a. Reasons for such cessation (أ الأسباب الداعية لإٰڈاء النشاط. b. Evidence that they have fully discharged their obligation toward their clients and policyholders, they have set aside adequate reserves to meet their obligations, and they have transferred all policies in force to another Company or Insurance and Reinsurance Services Provider. (ب ما يثبت أٰڈم قد أبرأوا ذممهم تماماً من ال؅قاماٮڈم الناجمة عن وثائق التأم؈ن الصادرة مٔڈم أو بواسطْڈم، أو أٰڈم قد وضعوا مخصصات كافية لسداد ال؅قاماٮڈم، أو أٰڈم حولوا تلك الوثا ئق إڲى شخص مماثل لهم. c. The wording of the cessation notice before publishing in two of the local newspapers that shall state their intention to cease operations in one class or classes of insurance and that policyholder’s and interested parties shall file their objections to SAMA within a period not exceeding three months from the publishing date of the notice. (ج صيغة الإعلان المزمع نشره ࢭي صحيفت؈ن محليت؈ن الذي يوضح أٰڈم يع؅قمون إٰڈاء نشاطهم كلياً ࢭي فرع أو أك؆ر من فروع التأم؈ن، وعڴى حملة الوثائق والم ستفيدين وأصحاب الشأن أن يقدموا اع؅راضهم عڴى إٰڈاء النشاط للمؤسسة ࢭي مدة أقصاها ثلاثة أشهر من تاريخ نشر الإعلان. 2. SAMA’s written approval shall be obtained before cessation of operations. لا يجوز إٰڈاء النشاط إلا بموافقة كتابية مسبقة من المؤسسة.
