If a person makes, in good faith, structures or plants on a land owned by another
person using his own materials, he may remove such structures or plants if the
removal does not cause damage to the land; if the removal causes damage to
the land or if the person who makes the structures or plants does not demand
their removal, the owner may choose either to pay the value of the materials
and labor fees or an amount equal to the amount of appreciation of the land
due to such structures or plants. If the value of the structures or plants is too
high for the landowner to pay, he may demand transfer of ownership of the land
to the person who made the structures or plants against a fair compensation.
