If the marriage contract is dissolved due to a defect in either spouse, the court shall decide
the following:
1. If a defect in either spouse occurs after consummation, the husband may not recover the
paid portion of the dowry.
2. If a defect in either spouse occurs prior to the conclusion of the marriage contract and the
dissolution is made prior to consummation or khalwa, the husband may recover the paid
portion of the dowry, and the remainder shall be forfeited, even if deferred.
3. If a defect in the husband occurs prior to the conclusion of the marriage contract and the
dissolution is made after consummation or khalwa, the wife shall be entitled to the dowry.
4. If a defect in the wife occurs prior to the conclusion of the marriage contract and the
dissolution is made after consummation or khalwa, the wife shall be entitled to the dowry.
The husband may claim the dowry from the person who deceived him.
