A judgment of the total or partial invalidity of the decision granting the protection document shall render the decision null and void from its date of issuance, within the scope of what is nullified. However, the decision to nullify the Law of Patents, Layout Designs of Integrated Circuits, Plant Varieties, and Industrial Designs protection document shall not entail a refund of the sums paid for the license to exploit it, unless the licensee proves that what he gained, as a result of the license, is not equal to what he paid, in which case he may recover the amount exceeding the gain he received. The decision of the annulment of granting the protection document shall be published after its issuance, and shall be effective vis-à-vis a third party from its date of publication.
