If the Supreme Administrative Court overturns the challenged judgment on
grounds of lack of jurisdiction, it shall determine the jurisdiction issue, and it
shall, if necessary, refer the case to the competent court.
Law of Procedure before the Board of Grievances
If the Supreme Administrative Court overturns the judgment for other reasons,
it shall refer the case to the court rendering the challenged judgment to decide
it by different judges. In such case, the court to which the case is referred shall
observe the principle applied to the judgment of the Supreme Administrative
Court.
Nonetheless, if the court overturns the challenged judgment for a second time
and the subject matter is valid for decision, the court shall rule on such subject
matter.
