Without prejudice to Article 125 of this Law, the following conditions shall be observed:
1. If the custodian is a woman, she must not be married to a man who is not a mahram to
the person subject of custody, unless it is in the interest of said person.
2. If the custodian is a man and the person subject of custody is female, the custodian must
be a mahram to said person and a woman capable of caring for her must reside with him.
