1. When a dispute arises between service providers in relation to interconnection or access, and the parties fail to reach an amicable resolution, either party to the dispute may submit a complaint to CST requesting a mandatory dispute resolution under the provisions and procedures set forth in this Article. 2. CST shall – within 15 days of receiving a request in accordance with this Article – set a date for the defendant to submit his reply to the complaint, and the time for the complainant to submit his response to the defendant,s reply. Chapter VIII : Resolution of Disputes between Service Providers Implementing Regulations of the Telecommunications & Information Technology Law 3. On a case by case basis, , CST shall determine the time limit available for each person to submit his documents to CST, considering the difficulty of obtaining the information required to be submitted. 4. The defendant shall reply to all facts of the dispute set out in the complaint. 5. If the defendant fails to submit his reply within the specified time limit without an acceptable excuse to CST, CST may issue its decision on the complaint without waiting for said reply. 6. In his response to the defendant’s reply, the complainant shall refute all the arguments set out therein. 7. No additional documents shall be submitted after the expiry of the deadline for exchanging responses and replies, unless CST decides otherwise. 8. CST shall, upon examining the facts of the dispute and each party’s response to the statements of the other party, issue a reasoned decision to resolve the dispute, and immediately notify all parties thereof. 9. CST’s decisions to resolve interconnection or access disputes shall be binding as of the date of notification thereof.
