1.A person having a prima facie claim may file a summary case before the court having jurisdiction over the merits of the case for injunction against interference with possession or recovery of possession. The judge shall issue an injunction against interference with possession or recovery of possession if deemed justifiable. Such an injunction shall have no effect on the merits of the claim, nor be deemed as evidence therefor. A person disputing the basis of such claim may resort to court as provided for in this Law. 2.A possessory action may not be combined with a claim of ownership ;otherwise, the possessory action shall be deemed forfeited. A defendant in a possessory action may not base his defense on a claim of ownership and his claim of ownership may not be granted prior to determination of the possessory action and execution of judgment; unless he actually relinquishes his possession to the adverse party.
