1. A litigant may, in the following cases, file with the court a motion to order an
adverse litigant to produce documents in his possession that are material to
the case:
a) If the law allows the litigant to demand production or delivery of
documents.
b) If a document is a joint document between the litigant and the adverse
litigant. A document shall be deemed joint if it serves the interest of both
litigants or establishes their reciprocal obligations and rights.
c) If the adverse litigant relies on such document at any stage of the case.
2. The motion referred to in paragraph (1) of this Article shall not be granted
unless it provides the following:
a) A detailed description of the document and its contents.
b) The evidence and circumstances indicating that the document is in the
possession of the adverse litigant.
c) The fact referenced in the document and the grounds for ordering the
adverse litigant to produce the same.
