In a disciplinary action, an employee may personally attend a hearing or appoint
an attorney. The court may require said employee to appear in person for
questioning and he may present his defense in writing or orally. If neither the
employee nor his attorney attends despite being notified, the court shall
proceed with the case; in which case, its judgment shall be deemed a judgment
in presence.
