199. Commitment to Marine Environment Protection Conventions 1. To protect the marine environment in KSA ports and surrounding waters of the Arabian Gulf, the Gulf of Oman, the Red Sea and the Arabian Sea, all captains of the ships and owners of the ships shall prevent pollution from ship-based sources in ports and the marine environment. They shall also abide by the standards outlined in the relevant conventions and apply the minimum standards of this Regulation. The competent entity may expand the requirements for compliance with international conventions or maritime regulations and standards within the requirements for the prevention of pollution of ports and adjacent waters. These extended requirements can apply to any commercial, recreational, fishing, or conventional ships, regardless of its purpose, origin, flag, trade, propulsion system, or size. 200. Waste Management in Ports (Ships' Waste Reception Facilities) 1. At ports, waste is managed, collected, transported, sorted, stored, imported, exported, treated, and safely disposed of, in accordance with the Waste Management Law issued by National Center for Waste Management. 2. The implementing procedures for the ships’ waste reception shall be as follows: 2.1 The ship or maritime unit shall fill out and send an ANF to its shipping agent. 2.2 A shipping agent selects a suitable carrier, licensed by the Authority or the competent entity, for the transport of waste. 2.3 The licensed carrier transport the waste to an adequate center licensed by the Authority or the waste treatment competent entity in accordance with KSA environmental procedures. 2.4 National Center for Waste Management issues a Waste Delivery Receipt (WDR) upon receiving the waste and sends the same to the shipping agent of the ship. Operating Regulation 2.5 The shipping agent is responsible for providing the ship with WDR, which is signed and sealed by the National Center for Waste Management. 2.6 The shipping agent is responsible for sending copies of (ANF) and a copy of (WDR) to the competent entity. 2.7 Collaboration is made between the Authority’s Environmental Units and the Environmental Inspection and Compliance Department (National Center for Waste Management) to monitor processes and address any complaint from any entity concerning the provision of ship’s waste receiving services. 201. Waste Disposal Fees 1. Waste disposal fees are collected, whether or not the ship desires to leverage this service, as per the Law of Port Service Fees and Charges. 2. The competent entity has the right to impose any other fees related to waste management in ports, in accordance with the services provided as per the Law of Port Service Fees and Charges. 202. Oil Pollution from Non-Oil Tankers 1. Owner or agent of the ship, such as passenger ships, bulk cargo ships, public goods ships, container ships, or maritime crafts, shall possess and maintain a valid comprehensive insurance policy upon entering the port. Such insurance policy shall cover liability for expenses resulting from incidents such as cleaning operations arising out of fuel or oil leaks. Additionally, owner or agent of the ship shall have a valid certificate confirming the validity of such insurance coverage, along with a P&I Club valid membership document. 2. If oils and their derivatives leak from the ship or maritime crafts into the sea, the captain of the ship shall promptly inform the port of the incident and the circumstances that led thereto. Additionally, arrangements shall be made for taking immediate necessary actions to stop the oil leaks, identify its causes, and undertake oil control measures. 3. The discharge of oils, oil-water mixtures, harmful substances, deceased animals, or parts thereof within the port boundaries, whether onshore or offshore, is strictly prohibited, without the approval of the port administration or the related entities. 4.
