The Governor – or his designee – may assign any person he deems appropriate
to investigate violators of the provisions of the Law, regulations, or regulatory
decisions. Said investigator shall, for this purpose, take the following procedures:
1. Summon the offender or any person involved in the violation, as he deems
appropriate, for investigation;
2. Draft an investigation report; investigation may be conducted via electronic
means;
3. Refer the report to the competent department for prosecution before the
committee if it is established through the investigation that there is evidence
or presumptions establishing the occurrence of the violation, and complete
the necessary actions regarding the facts or persons subject of the violation;
4. The department in charge of prosecution before the committee shall
request the committee to order the offender to return the proceeds he has
earned as a result of the violation to CST, if the committee establishes the
offender to be guilty of said violation, after returning the remainder of the
financial consideration to the user. CST may set the necessary requirements
for implementing this Paragraph, including, but not limited to, the mechanism
for calculating returns, and determining the responsibilities and obligations
of the parties associated with the violation.
