Witness testimonies may be admissible in cases in which written proof is
required, in the following cases:
1. If commencement of proof by writing exists.
2. If written evidence cannot be obtained due to material or moral reasons.
Material reasons include the absence of a person who can assume the task
of writing and cases where the person requesting proof is a third person who
is not a party to the contract. Moral reasons include, among others,
relationships between spouses, in-laws, and kinships up to the fourth

degree.
3. If it is established that the claimant has lost the written evidence for reasons
beyond his control.
