29. Compulsory Tugging 1. Notifications of arrival, departure, or movement shall be considered a request for towing by one or more tugboats. The tugboat shall be ready at the time set for the ship arrival, departure, or movement. 2. The tugboat shall provide the tugging ropes required for oil tankers and bulk or liquid cargo ships of any size and type, at the expense of the ship, subject of towage, according to the approved tariff. Other types of ships shall provide appropriate tugging ropes with adequate strength and length. 30. Conditions for Towing and Tugging 1. The tugboat is requested from the service provider by the maritime pilot during docking and departure. 2. Using the tugboat shall be mandatory for all ship maneuvers within the port according to the ship requirements and surrounding factors. 3. Towing or tugging shall begin when the tugboat is ready to directly receive orders to tow, tug, or receive towing ropes, whichever is faster. 4. The towing or tugging shall end upon the execution of the final orders issued by the maritime pilot, in cooperation with the captain of the ship towed by the tugboat, to stop the towing and safely move away from the ship. From the beginning to the end of the towing or tugging, the tugboat shall be under the control and direct responsibility of the captain of the ship being towed by the tugboat. The tugboat captain shall act as an assistant of the captain of the ship being tugged. 6. The registered owner of the towed ship shall be liable to the port for any loss or damage that may arise during the tugging. Operating Regulation 7. The port shall bear no responsibilities for any delay, stoppage, or block the tugboat may face, regardless of the reason. 31. Towing and Tugging Services on Port’s Wharfs Towing, tugging, or any other assistance for approaching or leaving the wharf shall only be permitted by virtue of the terms and conditions set out in Paragraph (30) of Article 12.
