Pilotage and Mandatory Pilotage Areas and Exceptions 20. Mandatory Pilotage Pilotage shall be mandatory for any ship weighing more than 150 tons of registered net tonnage, upon: 1. entering or departing from the port; 2. berthing or leaving the wharf; 3. moving from one place to another in the port; or 4. entering and leaving anchorage area. 5. No maritime pilot may board the high-speed craft, taking into account the instructions and guidelines of the maritime watchtower supervisor. Operating Regulation 21. Ships Exempted from Pilotage 7. Warships; 8. Non-commercial government ships; 9. Fishing ships and ships weighing less than 150 tons of registered net tonnage; 10. Yachts and pleasure craft; 11. Ports’ maritime units; 12. Ships with exemption certificates issued by the Authority; and 13. Maritime units operating in projects within the port boundaries after having the necessary approvals from port administration, in accordance with the conditions and requirements specified by port administration. 22. Safety of Maritime Pilot upon Embarking or Disembarking the Ship 1. The captain of the ship, which utilizes the maritime pilotage services, shall facilitate the maritime pilot’s embarking or disembarking. 2. The ship requiring maritime pilotage services shall be equipped with safe means for embarking and disembarking in accordance with Chapter V of the International Convention for the Safety of Life at Sea (SOLAS), 1974, as amended. 3. The captain of the ship shall be responsible for equipping the ship, which requires maritime pilotage, with all necessary means and equipment for the safe embarking or disembarking of the maritime pilot. Otherwise, the port administration is entitled to take the necessary action. 4. The captain of the ship or the registered owner shall be responsible for damage resulting from failure to equip the ship with the necessary equipment that enables the maritime pilot to embark or disembark the ship; and shall bear the costs imposed by the port administration as a result of such damage. 23. Ship Pilotage Equipment 1. The captain of the ship who requests maritime pilotage services shall provide the following: 1.1 Radio communication devices with frequencies compatible with the port’s frequencies; 1.2 Safe and efficient means for maritime pilot’s embarking and disembarking, ensuring that the maritime pilot face no obstacles or difficulties on the ship; 1.3 A highly efficient and fully functional radar system; 1.4 A fully functioning steering rudder with a highly efficient indicator displaying speed and rotation per minute, along with a bathymetry device and any other relevant navigation devices; and 1.5 A fully functional back-up generator.
