1. Penalties shall be determined based on the severity and frequency of the violation. At its discretion, the Authority may impose multiple penalties (separately or collectively) for the same violation or violations related to each other. 2. The Authority may double the penalty and take any measures it deems appropriate to address the violation, if the violation is repeated within one year of the date of committing the previous violation. 3. The Authority may apply penalties to anyone violating the provisions of these Regulations, according to the following sequence: a. Send a warning to the agent to rectify the violation within a period specified by the Authority according to the gravity of the violation. b. Apply a minimum financial penalty of SAR 5,000. c. Double the financial penalty set out in Paragraph (b) of this Article in case of recurrence. d. Apply a maximum financial penalty of SAR 50,000. e. Suspend the license for a period not exceeding 12 months. f. Cancel the license. In all cases, the shipping agent shall only apply for a new license after 3 years of the license cancellation date. g. The Authority shall collect the financial dues by deducting the same from the shipping agent’s bank guarantee after referring the matter to the competent entity. The agent shall reinstate the bank guarantee to the required amount within 15 days. Otherwise, the agent’s activity shall be suspended. 4. The Authority may apply the penalty for non-compliance with Article 8 of these Regulations, according to the following sequence: Regulations for Shipping Agents a. Send a warning, and if the agent fails to settle the payment within 5 days, the following financial penalty shall apply: If the dues exceed the value of the bank guarantee and the shipping agent fails to pay, the agent’s activity shall be suspended and shall not be reactivated until all due debts are paid and the value of the bank guarantee is reinstated. b. Suspend the license for a period not exceeding 12 twelve months. c. Cancel the license. In all cases, the shipping agent shall only apply for a new license after 3 years of the license cancellation date. d. The Authority shall collect the financial dues by deducting the same from the shipping agent’s bank guarantee after referring the matter to the competent entity. 5. High-risk violations that result in damage to lives, properties, public health, or public order shall be excluded from the sequence of penalties set out in Paragraphs (3) and (4) of this Article, and the Authority shall apply the penalty, it deems appropriate, based on the severity of the violation.
